Case Study: Obtain Payment of $500,000.00 for Window Company from Bond

Background

A large Long Island window company supplied product to a contractor working for the New York City Housing Authority. With the installation done the contractor ran into trouble on the project. It had trouble meeting its obligations and the window company was owed $500,000.00.

The Solution

We were retained by the window company to recoup its loss. Recognizing that the struggling contractor was backed by a major Midwest construction surety, we commenced suit in the United States District Court for the Eastern District of New York. The surety had difficulty finding any bona fide defense and sought time as it tried to get its principal to address the situation. We made a motion for summary judgment.

The Result

While the motion for summary judgment was pending, the construction surety settled with our client for the full amount.
