Case Study: Recovery of $800,000.00 in Cash Collateral from County

Background

A Long Island developer completed construction work on a property in Suffolk County. At that point it sought return of $800,000.00 in cash collateral which had been given to ensure performance of certain improvements. The County did not comply.

The Challenge

We are retained when the County balked at promptly returning the collateral. The excuses it used appeared specious. However, it remained intransigent.

The Solution

We commenced an action in the Supreme Court of the State of New York, County of Suffolk, to recover the collateral. As discovery was about to commence, the County finally relented and began constructive discussions.

The Result

We recovered the full amount of the collateral for the developer.
