Case Study: Dismissal of $600,000.00 in Claims by Contractor Against Owner

Background

The owner of a large facility in New Jersey hired a local rigging contractor to renovate and upgrade its property. The work proceeded slowly through substantial completion. Although the owner was not fully satisfied it was willing to accept the result until large claims were made for additional compensation.

The Solution

We were retained by the owner to negotiate with the contractor to a satisfactory resolution. Unfortunately, the contractor proved to be intransigent and ultimately brought suit in the United States District Court for the District of New Jersey for over $500,000.00. We defended vigorously primarily relying upon strict contract language regarding both contract scope and claims for additional compensation.

The Result

Early in the litigation we made a motion for summary judgment which was granted. The case was dismissed.
