Case Study: Construction Claims & Surety Litigation

Background

A construction surety issued bonds to a general contractor for a project in East Harlem, New York. When the project was completed, the electrical contractor asserted a $600,000.00 claim for additional compensation against both the general contractor and its surety.

The Challenge

We were retained by the surety to defend a case brought in the Supreme Court of the State of New York, County of New York. With the contractor/principal out of business, defense of the surety became more difficult.

Solution

We vigorously defended on the basis that the claims lacked merit and were improperly asserted against the surety. Substantial discovery and research confirmed our position.

The Result

The claim by the electrical contractor was ultimately disposed of.
