Background
A Manhattan construction management firm performing high-end projects for private owners became the target of an organization effort by local unions. For a time, the firm was able to fend off those efforts.
The Challenge
We were retained by the construction management firm to defend a lawsuit by a local union for allegedly unpaid benefits under the ERISA. The local urged that the firm was the “alter ego” of another company in which the principals of the firm had been involved.
The Solution
We defended the firm through trial in the United States District Court for the Southern District of New York. The principals of the firm testified at trial and were able to cogently explain their business dealings.
The Result
The Court dismissed all claims against the firm at the conclusion of trial.
