Defense of Fair Labor Standards Act Claim by Remote Worker

Background

A Staten Island general contractor became involved in various projects from Virginia up to Massachusetts. The workers were only periodically supervised by the home office.

The Challenge

One worker in particular made a large claim under the Fair Labor Standards Act for hours he claimed he worked, particularly for overtime. The contractor had only limited records of the worker’s activities.

The Solution

We combed the records to determine where we could demonstrate that the claims were fictitious.

Result

We were able to limit the claims to a relatively small sum and achieve settlement.
